For Public Officials:

Oregon Government Ethics Law has adopted an Administrative Rule, OAR 199-005-0015, that specifically addresses the gift exception in ORS 244.020(7)(b)(E). The Rule specifies that its purpose is “to allow public officials to attend organized, planned events and engage with the members of organizations when representing” state government, a local government, or a special government body.

 Public guidance provided by OGEC outlines a number of factors in the Rule that serve as indicia of whether paid expenses would qualify under this gift exception, including: 

  • A large number of people or groups are invited.
  • The invitations or programs are sent in advance.
  • The event is publicized.
  • The reception, meal, or meeting is open to the public.
  • Written materials, such as a printed program, are available.

 Not every factor has to be met in each circumstance. However, in each case when a public official is offered admission to, or the cost of food or beverages at, a reception, meal, or meeting, they will need to evaluate the above factors to make their own determination whether the paid expenses could be accepted under this gift exception. Questions or guidance about how to evaluate these factors should be directed to OGEC.
